Hawaii Kratom and 7-OH Laws: Current Regulations
Kratom status
Not banned statewide
Hawaii currently does not have an enacted statewide law specifically banning kratom or establishing a comprehensive Kratom Consumer Protection Act. Kratom, mitragynine, and 7-hydroxymitragynine are not specifically listed in Hawaii's current Schedule I controlled-substance statute.
Minimum age
No statewide kratom-specific age limit
Hawaii currently has no enacted statewide minimum purchasing age specifically for kratom. Proposed legislation would have restricted sales to people under 18, but those provisions did not become current law.
7-OH concentration limits
No statewide numeric limit
Hawaii currently has no enacted state-specific maximum concentration for 7-hydroxymitragynine (7-OH). A proposed Kratom Consumer Protection Act would have established a 2% alkaloid-composition limit, but that proposal did not become law.
Synthetic alkaloids
No kratom-specific statewide prohibition
Hawaii currently does not have an enacted kratom-specific statewide prohibition on synthetic mitragynine, synthetic 7-OH, or other synthetically derived kratom compounds. Those restrictions appeared in proposed legislation that did not advance into law.
Hawaii currently does not have a comprehensive statewide Kratom Consumer Protection Act establishing age, 7-OH concentration, labeling, registration, or synthetic-alkaloid standards. HB 717 and SB 463 proposed such a framework, including an 18+ sales requirement, a 2% 7-OH limit, registration, labeling, testing, and synthetic-alkaloid restrictions, but the measures did not become law.
Is 7-OH or Kratom Legal in Hawaii?
Hawaii currently does not have a statewide law specifically banning kratom or establishing a numerical 7-OH concentration limit.
Hawaii has considered multiple proposals to regulate kratom, but a comprehensive Kratom Consumer Protection Act has not been enacted. As a result, the state currently does not have the type of kratom-specific regulatory system found in states such as Arizona, Colorado, or Nebraska.
Under currently enacted Hawaii statewide law, there is no kratom-specific provision establishing:
- A minimum statewide kratom purchasing age
- A numerical 7-OH concentration limit
- A specific prohibition on synthetic kratom alkaloids
- A statewide kratom product-registration system
- A comprehensive kratom-specific labeling requirement
HB 717 would have created many of these requirements—including 18+ sales, a 2% 7-OH limit, registration, testing, and synthetic-product restrictions—but those provisions should not be presented as current Hawaii law.
Important federal distinction
Hawaii's lack of a kratom-specific state law does not determine whether a particular kratom product complies with federal law. FDA states that there are no FDA-approved kratom drug products or OTC drugs containing kratom legally marketed in the United States and continues to warn consumers about kratom and concentrated 7-OH products.
DEA published a Notice of Intent in July 2026 to temporarily place 7-OH above a specified threshold into Schedule I. As of August 14, 2026, the Federal Register still reflects the notice-of-intent stage rather than a published temporary scheduling order for 7-OH. The proposed federal action excludes botanical kratom containing naturally occurring 7-OH below the specified threshold.

Hawaii 7-OH and Kratom Treatment FAQs
Hawaii does not impose a total ban on every product containing naturally occurring 7-OH. However, products sold or delivered in Hawaii cannot contain more than 0.5 milligrams of 7-OH per gram or more than 1 milligram per serving.
Hawaii also prohibits kratom products containing synthetic 7-OH, synthetic mitragynine or other synthetically derived kratom compounds. Many concentrated tablets, gummies, shots and similar products may not comply with these requirements.
Hawaii does not have a total statewide ban on compliant kratom products for adults age 21 and older.
Anyone under 21 is prohibited from purchasing or possessing kratom, kratom extracts or kratom products. Products must also comply with Hawaii's concentration, formulation, labeling, display and retail requirements.
Hawaii has not enacted a total ban on all naturally occurring 7-OH, but it already prohibits synthetic 7-OH and restricts the amount permitted in kratom products.
Separately, the DEA announced its intent to temporarily place 7-OH above a specified threshold into Schedule I under federal law. As of the August 6, 2026 legal review date, the Federal Register contained the notice of intent, but the final temporary scheduling order had not yet been published. Federal status could change shortly after publication of this page.
Consider speaking with a medical provider before your supply ends, especially if you use 7-OH every day or experience withdrawal symptoms between doses.

7-hydroxymitragynine — abbreviated 7-OH, 7OH or 7-HMG — is one of several alkaloids that occur naturally in the kratom plant, Mitragyna speciosa, though only in small amounts in raw kratom leaf.
7-OH is not the same as kratom itself. Kratom refers to the whole botanical material, which contains many alkaloids beyond 7-OH. Commercial 7-OH tablets, gummies, shots and similar products may contain added, isolated or enhanced concentrations that are substantially different from traditional kratom leaf.

These are synthetically derived compounds related to 7-hydroxymitragynine. Hawaii prohibits synthetically derived kratom compounds in products sold in the state.
